Belviq (also known as lorcaserin) is a drug that was approved by the FDA in 2012 for treatment of obesity. Belviq is marketed and distributed by Eisai, Inc. in the US, and an extended-release version of the drug is also available. However, after trial data showed that the drug could possibly increase the risk of certain types of cancer, FDA asked the manufacturer in 2020, to pull off the drug from the market owing to these risks. Many patients have filed lawsuits since then stating that they developed cancer because of the drug. That’s the crux of a Belviq lawsuit

Filing a Belviq lawsuit

Patients who have consumed either Belviq or Belviq XR and were diagnosed with cancer later may have a valid lawsuit. Belviq and Belviq XR have been associated with three types of cancer — pancreatic, colorectal, and lung cancer, but even if you have developed other cancers, you may consider talking to an attorney. Lawyers pursuing Belviq lawsuits are seeking compensation for clients that would cover all medical expenses, pain & suffering, and loss of wages, besides punitive and compensatory damages.

Meeting a lawyer

If you believe that you may have a Belviq lawsuit, your first step should be about finding an attorney or law firm that is accepting such lawsuits. The statute of limitations in many states only allow one to two years to file such lawsuits after the diagnosis, so you have to act quickly. Keep in mind that only an experienced attorney can help in evaluating the actual worth and scope of your lawsuit, so the initial consultation is important. Most law firms are taking Belviq lawsuits on a contingency basis, which means you don’t have to pay them a fee, unless a settlement is won. This may vary between attorneys and cases, so ask in advance.

Other important aspects

To file a Belviq lawsuit, you will obviously need evidence, and the day you are diagnosed with cancer, start collecting evidence. You also need to stay organized with your payments and losses, so that you have all the receipts and medical bills, to get the compensation you deserve. Note that all Belviq lawsuits are separate lawsuits, and not a part of class action. These cases will eventually consolidate into a multidistrict litigation, which will expedite the settlement process. The judge will hear a few bellwether cases, and the judgement usually dictates the course of settlement for other cases.
